The White House press secretary is trying the same argument. She wants to claim that they’re following a process; that they immediately contacted the National Achieves; and invited a search. They want to skip the fact that he illegally took the documents in the first place. He initially lied and said that they were ‘inadvertently’ taken. If you’ve ever worked in a SCIF, you know that’s impossible. He tried to say that it was a onetime mistake, but they’ve uncovered many, many documents that span a decade or so. He claims to have invited a search of his property, but then we see that the search was actually done by his lawyers and staff. He claimed that after they did a search, there were no more documents, but then they find more and more. The initial reports were that the documents were classified SCI documents. That’s why there’s endless discussions about him taking such items from a SCIF. SCI is a type of Top Secret classification and is actually higher. He didn’t hide them for a year and avoid requests… he just stole them and kept them for years and years. Trump’s people complain about the midnight raid on Trump’s home while his lawyers were forced to wait outside. Biden gets to have his lawyers do the searching.
As you say, ignoring a court-ordered subpoena is an indictable offence. We’ll see how that ends up. Regardless of what you think, the POTUS does have the authority to declassify which is what Trump claims. Biden did not.
So, taking the documents out of the secure area, as a Senator or VP, violates 18 USC 1924 which mandates five years in jail. If he (or his son perhaps) provided any of those documents to China or Russia, then he has also violated the Espionage Act of 1917 which calls for the death penalty. The Rosenbergs, an engineer for the U.S. Army Signal Corps, and his wife, were both executed for violating the Espionage Act. They gave classified documents to the Soviet Union.
